Tooth pulled without consent. Do I have to pay for this?

A few days ago, I was supposed to have my four wisdom teeth extracted under general anesthesia. After I woke up, the dentist told me she had overlooked cavities in the neighboring tooth and would have to extract that as well. However, they had taken an X-ray beforehand to check for cavities, and I was told everything was fine.

The possibility of caries being discovered wasn't even considered, and I wasn't informed of the risks. I didn't consent to or agree to the extraction of my fifth tooth in any way. I wasn't even asked whether it could be done in case of complications.

Since I'm paying for it myself, I'm wondering if I have to cover the costs for the fifth tooth or if I should object. I appreciate your help✨

So usually your dentist is completely wrong there. To pull a tooth that is infested with caries is one of the last solutions anyway. If she had made a filling it would have been something else, but simply pulling the tooth is really the last.

Do not pay the costs for the fifth tooth. You agreed for the wisdom teeth and for no other. Should the dentist cause problems according to the document where your signature is to be seen with the consent. She won’t be here.

Can also talk to her about what the whole thing should be. With a lawyer, you could threaten her without any problems.

It is important to obtain legal advice in such cases, as this depends on the laws and regulations in your country. In principle, medical treatment should not take place without the patient’s consent. If a tooth has been pulled without your consent and this has not been discussed in advance, this could have legal consequences.

It would be advisable to contact a lawyer or a consumer protection organization to discuss your specific situation. You may be able to proceed against unlawful treatment and do not have to bear the costs for the additional tooth.
