How do I get my wage tax certificate if my employer "doesn't have access to it"?

Hello everyone

Unfortunately, I can no longer find my wage tax certificate from last year. Normally, the employer, or in this case, the former employer, is required to retain this data for 10 years. However, my former employer (a daycare center) was acquired by a larger provider, and as a result, my tax advisor changed.

The current manager of my old daycare center (luckily a good friend of mine) contacted my tax advisor about my certificate, but the advisor said he didn't have access to the data (because he's a new advisor). The manager doesn't really know what to do.

Okay, then I'll just call the tax office and apply for a new certificate, I thought. However, no one has been answering the phone there for weeks, and they haven't responded to emails either. I would go in person, but I now live seven hours away.

Does anyone have any idea how I can still get the certificate? Since my former employer, or in this case, my former tax advisor, is legally obligated to retain this data for 10 years, or am I missing something?

I don't have much hope, but maybe someone has an idea.

The AG is responsible here, because it is subject to retention, not the StB. However, with the handing out of the LStB to the AN, it has in principle fulfilled its duty. You can only ask him to send a copy.

Alternatively, you can also inform your own FA in writing that you no longer have the LStB and clarify the facts there directly with the SB.

Your FA can’t do that. Firstly, lack of competence (if appropriate only the FA at the seat of the AG), secondly lack of authorization.

However, no one has been answering the phone for weeks and emails are not answered.

I just think that’s wrong. Each FA has regular contact and speaking times. I always telephone with the relevant SB at 8:00 in the morning, if necessary, and always get through. And, by the way, always get friendly information.

You can apply for access to elster.de and request the certificate retrieval there. This allows you to retrieve wage tax certificates. For 2021, this certainly still works, possibly also for older years.

The AG must cancel the data, not the tax advisor.
