What does the increase in the THC limit mean for the old cases?

Good morning !

The THC limit will likely be raised to 3.0 mg/dL in whole blood in the not-too-distant future. (Goslar Traffic Court a week ago)

What then actually happens with cases where, under the old legal situation, a person committed a "drug-related driving" but, under the new legal situation, it is no longer a drug-related driving incident?

Like me, for example… I'm driving at 1.6 NG in my thoroughbred. I'm currently taking a MPU for this reason (but not only for this reason) and am paying off the fine in small installments.

In the Goslar traffic court there was talk of "amnesty for old cases"

Does anyone there know anything concrete? Thanks in advance, as always!

Although the day of the Transport Court has chosen to increase the limit value, no new limit value has been recommended. The 3 ng/ml mentioned by you are therefore purely speculative.

The working group recommends giving up the legislator to adequately increase the current threshold for the THC concentration of 1.0 ng THC per ml of blood serum.

The Transport Court Day has not yet given a recommendation on the amnesty of road traffic offences related to cannabis following the introduction of a new limit.

As far as I am aware, only a recommendation has been made to raise the limit value, no specific value being named. The fact that there is also an increase in the limit value is currently not certain.

What a “Amnestia for Altfalls” means in concrete terms is currently unclear, as there are no concrete statements or even draft laws. We need to wait for everything in the bill that has been announced this year. It probably won’t stand for a majority.

What it means could be:

Withdrawal driving licences shall be returned if they have been withdrawn due to an exceeding of the 1 ng limit value or due to an MPU arranged thereon and the value was below the newly defined limit value. Driving licences are also reimbursed for other reasons which would no longer be a reason for withdrawal under the new law, e.g. repeated property offences, modified MPU directives etc. Concretely paid fees, detectable MPU costs etc. are to be reimbursed.

Yeah, stupid thing. Unfortunately, everything is too uncertain. We don’t even know if it comes to legalization at all. If the law is to be binding, the Union may intervene in the Bunderat. There is also a lot to consider at international level. Honestly, I wouldn’t expect the legalization project to be far enough advanced by next year to make a positive impact on your case.
