Why would he?

The AG introduces AN to take over activities. If night work is agreed in the contract, there is no wish concert.

If there is an works council, it has a right to speak in the shift plan. That doesn’t mean that nobody has to take over the night shift.

Without BR, the AG exercises its right to serve.

The AG has a problem only if none of the AN is contractually obliged to work at night.

It’s up to me. If the work contract is that you have night shifts then you can use someone but if it is not regulated in the work contract I would say that the boss should do it because the work is on a voluntary basis at night and anyone must do it.

If your work contract is not explicitly stated that you can’t do a night shift, then you can definitely be planned for it.
