Von dort kann man Dir dann neben einer möglichen Führerscheinsperre auch die Nutzung von Kraftfahrzeugen wie Mofas untersagen.
Ein Verstoß gegen eine derartige amtliche Untersagung wird dann zu einer Straftat.
Wenn mit Prüfbescheinigung die Fahrerlaubnis für ein Mofa gemeint ist, dann stimmt das.
Es gibt dann ja auch noch die technische Prüfbescheinigung des Mofas, vielleicht meinte er diese ?
Nein, Du liegst hier in beiden Punkten falsch. Erstens gibt es keine Fahrerlaubnis für Mofa im Sinne der FeV. Deswegen handelt man zunächst auch selbst dann “nur” ordnungswidrig, wenn man überhaupt nicht in Besitz einer Prüfbesch. oder gar einer echten Fahrerlaubnis wäre.
Letzteres wäre die ABE, aber danach wurde inhaltlich nicht gefragt.
