Why is smoking in public not considered bodily harm?

The basic condition of a bodily injury is that someone jeopardizes or physically harms the health of another negligent or intentionally. But how can one accuse a smoker of the body injury if it cannot be determined exactly when a body injury actually occurs as such?

There was actually the discussion or the comparison of cigarette quality to exhaust gases from cars.
