According to Wikipedia, there was the first patent for a pen-like device in 1888 by John J. loud.

That is why the first ballpoint pens as we know them exist very little later, at least in prototypes.

No, the first patent 1888, i.e. 19. Century, but at that time it was only possible to make short marks. The system was gradually improved.

On 25 April 1938 Lazlo Schweiger (“Biro”) received the patent in Hungary, in 1943 he received a US patent, after which the production of the pens began. But the breakthrough came with the British businessman Henry Georg Martin, he acquired patent rights and started a production in England. Source: Wikipedia.
