Seller won't provide vehicle registration? What should I do?
Hello.
In June 22 we were looking for a beginner's vehicle for my son because he had just gotten his new driver's license.
We quickly found what we were looking for on Mobile.de.
Unfortunately, the distance to the vehicle was a bit too great (approx. 120 km).
The seller then offered to bring the vehicle to us for inspection, as she would be passing by in the next few days anyway.
No sooner said than done. We arrived, inspected the car, negotiated a few things, and everything was perfect.
Now the real problem.
The seller said she had left the vehicle registration document at home.
However, she would send it by registered mail immediately afterward.
We then recorded this in writing and in a contract.
I took a photo of her ID. She received the full purchase price of €1,900.
You also left the vehicle with us registered, as re-registration was not possible without a letter.
After a week of waiting, unfortunately no letter arrived.
No post, nothing.
After 2 weeks I called you several times, but no answer.
She reads my WhatsApp messages, but I don't get a reply.
After waiting for two months, I became very suspicious. I went to the police because I suspected the vehicle might have been stolen.
Police checked everything.
She is actually the owner.
Insurance/tax is still paid.
However, the police refused to file a complaint because it is a civil matter.
After I wrote to the lady several times by registered mail without success/response, it was already December.
We did not move the vehicle because it was too risky for us.
(accident etc.)
In January 23 the first sign of life from her
She has instructed the traffic department to immobilize the vehicle.
Then, one Monday, without us noticing, the stickers were actually removed. We called the traffic department and asked what was going on.
Legally it is allowed because the owner has not paid insurance for 2 months.
After that, I had no choice but to hire a lawyer.
However, my lawyer has done little so far (in 2 months).
Except he was able to find the current address. Apparently she's moved.
He didn't write or call the woman. He didn't do anything.
Whenever I write an email asking if there is any news, I don't even get a reply to my email.
Called there 1-2 times "YES IT'S BEING PROCESSED" we'll get back to you.
The fact is that I need a new lawyer
I've had a paid-for vehicle in front of my house for 10 months, which we can't use without a title.
It's lost a lot of value because it's not been driven. I've also tried to explain the problem to the traffic department. Despite having a purchase agreement, I haven't received a new one because the owner hasn't reported it lost.
I also drove to her home (120km) unfortunately nobody does
Do you have any idea what else I can do?
Or any tips.
Unfortunately, you can’t do anything except the letter.
buy the dealer next time, save the circus.
On the subject of action:
we have to do the letter was then 2 years later with us and the car was as good as scrap
The vehicle is almost scrap now.
But, I mean, I’m sure I’m entitled to compensation? Or, of course, with a reasonable lawyer.
We got compensation but only after we were in court for the second time to claim compensation
A tip from me would be… please find a better lawyer. Yours isn’t the bean!
