Consumer Knight Diesel compensation?

I stumbled upon the website verbraucherritter.de by chance. Based on the diesel scandal, I'm owed €19,000 based on the car's data…

How does this work? Is this site reputable? Will it cost me anything? Does anyone have experience with this topic?

That’s the crack point. The website works free of charge, but not the partner firms.

Since diesel cases are not unproblematic with regard to the limitation period, an expensive surprise could threaten.

What kind of car are you driving and when did you buy it?

You should be aware of this:

  • The supposedly so great big consumer chancellors are very much insane. It will be advertised with promises that cannot be complied with as a rule. It is often only a matter of getting to lawyer fees, which is then at the expense of the consumer or legal protection insurance.
  • Suppose you really have a claim, you will only get the 19,000€ if you return your car. You want that?
  • If you want to believe the page, you have to give the lawyers a complaint. They’ll make a complaint in your name.

When did you buy your car? This aspect often excludes any claims. You’d have to have the car for quite a long time and have clearly acquired the diesel scandal before you get acquainted. If you buy a corresponding car with already known scandal, it is of course your fault and you have no claims. I’m sure I’m not in the year, but I think you should have bought the vehicle roughly before 2016… But maybe someone else can fix me here.

In addition, I am not quite sure whether – as already mentioned here – claims are not already guaranteed.

Your claims, if you’ve had them, are probably statute-barred. This makes no sense in this respect.

Yes but 3 years of knowledge. It is obvious that EA189 procedures are to be considered. This is still difficult in all other procedures. The car manufacturers I know therefore raise the limitation of the other procedures only when the conclusion of the purchase contract is over 10 years (§ 199 (3))

You’re right at 826.

But:

OLG München, Notice v. 20.07.2020 – 3 U 3018/20 – Bürgerservice (gesetze-bayern.de)

According to § 195 BGB, the regular limitation period is three years. This also applies to claims from § 826 BGB (cf. for example BGH, judgment of 15.11.2011, XI ZR 54/09)

The BGH also confirmed in 2020.

826 usually goes through when there is a communication from the Federal Agency for Motor Vehicles.
