VAT on cancellation?
Hello, a question:
Initial situation: We create an invoice for a car for 11900 € (VAT 1900 €). The customer does not take the car and we cancel the invoice.
The customer then submits the invoice to their VAT return and receives the VAT from the tax office. We have canceled the invoice and will not pay any VAT to the tax office.
Who bears the risk if something like this happens? Can we be held liable for damages by the tax office?
As long as you have sent the cancellation bill to the customer, the responsibility lies clear to this. If the customer is still in charge, the simple tax evasion of that is. There is no risk for you, as the corresponding accounting process is documented by the cancellation bill.
