Working overtime without a time account?

Am I obliged to work overtime without it being recorded in writing, for example in a time account, and how many do I have to do at all if there is no employment contract that specifies this? Above all, over what period of time? Nothing is regulated and it is simply decided freely when and it is not stated how long it will last, whether a week or a month.

You’ve got your weekly hours in your contract. Overtime can also be defined to a certain extent in the employment contract, but then it usually requires the operational necessity and not simply “for fun in pleasure”.

By the way, the statutory maximum number of hours is also valid for work contracts without time registration.

A manager is expected not to drop the handle after 40 hours. An appropriate overtime number is taken into account in the overtime wage.

This has nothing to do with “over-tariff” pay.

There is no entitlement to overtime paid in the case of fees above the statutory pension insurance ceiling and in the case of “services of a higher nature”, e.g. in the case of doctors, architects, lawyers, tax advisers.

if you’re referring to salary, that should be in the contract. e.g. 15 hours are to be accepted without compensation
