Theft or not?
My classmates in the last row have been collecting drink cans in the classroom cupboard for a while now, which are just lying around in the cupboard. After repeatedly asking other classmates to put these cans away, another classmate took them and handed them in. Now the last row is complaining that they were stolen inside and they want their deposit back. Who is right in this case or who is not?
Cans: approx. 145 pieces / value approx. 37€
The deposit was theirs, but whether they were allowed to use the class cabinet is not so clean.
Collecting 145 empty cans and having a “Müllberg” in the classroom cabinet is also not okay.
So someone has disposed of their garbage, they could have done it themselves.
This is theft and the injured have the right to compensation.
They were repeatedly asked to clean up their garbage. They didn’t do it because they were too lazy for it. If the cans are gone, that’s certainly not theft.
If the pupils concerned were not active before, they have tacitly transferred their property to the “collector”.
You’ve heard the request before that they should remove their garbage from the closet. Didn’t do it – bad luck!
If it had been other (powder-free) garbage, they would have left him to lie until some cleaning aid clears the closet and takes everything.
Even if they were asked several times and were not satisfied, the student had no right to simply take the doses. The cans are and still remain property of the last row.
Since the pupil took the OHNE permission from them, the theft was. There’s nothing nice to talk about. The victims have a right to pay the deposit.
This is theft in my eyes only when the student has appropriated the cans. If he’s just disposed of the stuff professionally, then the will is missing.
On the contrary, he may even be entitled to compensation based on the management without order.
