Stornierung/Widerruf einer Reifenbestellung beim Autohändler möglich?
Hallo Zusammen,
ich habe eine Frage zum Widerrufs-/Vertragsrecht bei der Bestellung von Reifen bei einem Autohändler.
In der ersten Dezemberwoche habe ich bei meiner Vertragswerkstatt einen Satz Winterkompletträder bestellt. Eigentlich sollten die Räder innerhalb einer Woche geliefert werden; ich wurde aber nach einer Woche darauf hingewiesen, dass sich die Lieferung verzögern wird. Eine Woche darauf hat der Autohändler seinen bisherigen Standort geräumt und ist mittlerweile zu einem neuen Standort umgezogen. Vermutlich ging in dem ganzen Umzugsstress meine Reifenbestellung unter.
Nun habe ich lange Zeit geduldig gewartet, weil ich zurzeit mein Auto eh nur selten brauche. Anfang dieser Woche habe ich der Werkstatt dann eine E-Mail geschickt, dass meine Bestellung knapp zwei Monate her ist und dass ich für die kommenden zwei Monate keine Winterreifen mehr brauche (das Geld kann ich mir sparen) und ich darum bitte, dass der Auftrag/die Bestellung storniert wird.
Ich habe noch keine Antwort erhalten, möchte aber gerne wissen, ob ich in diesem Fall von der Bestellung zurücktreten kann, oder ob ich die Räder nun trotzdem abnehmen und bezahlen muss, sofern sie bereits beim Händler liegen.
