First of all, hello. I have a question regarding the taxation of profitable activities as a private individual. I'm 17 years old and buy used cell phones to refurbish/rework them and sell them for a profit. However, I'm wondering: "To what extent do I have to pay taxes on this as a private individual?" Since I don't want any problems, I've taken a break to get the right information. Of course, I have my legal guardian's permission. Additional information: I'm from North Rhine-Westphalia.

In most countries, including NRW, the sale of refurbished mobile phones could be regarded as commercial activity, as you regularly buy, prepare and profitably sell mobile phones. This could mean you have to pay income tax and, if necessary, turnover tax.

However, your youthful age could play a role here. As a 17-year-old, you could be under certain legal restrictions when it comes to business activities.

This is no longer a private activity, but a commercial activity, since all the facts of § 15 para. 2 p. 1 EStG are fulfilled (profit-making intention, sustainability, participation in general economic transport).

That alone is not enough. You also need the approval of the family court, § 112 BGB.

To what extent I have to tax this as a private person.

You must register a trade with the municipality within one month of the first activity (§ 14 GewO) and submit the questionnaire for tax collection electronically to the tax office (§ 138 AO). A late or missing trade registration can otherwise bring you a fine of up to €1,000 (§ 146 GewO).

Then, at the end of the year, you will start the corresponding winning and tax returns and forward them electronically to your tax office.

Later, you will receive the tax ruling in which the tax debts are fixed, which you will have to pay (for which you should deposit the taxes and not have spent).

In spite of the unlawful exercise, you have to tax all previous profits (§ 40, 41 AO) by surrendering the corresponding tax returns. Otherwise, you also make yourself criminal for tax evasion (§ 370 AO). From 14 years, you're a criminal.

YES the reason is in the tax system. It's not a hobby, there's an intention to win. That's the basic condition, age has nothing to do with and not with your parents' consent. You'd be on it, too. Then you just have to look into what kind of vaccination it belongs and voila.. everything that exceeds certain limits must be taxed. There's no mouse biting thread.

Regardless of this, however, other criteria – for example, industrial registration – must also be met if not, it can hail punishment. But the tax office doesn't care, it just wants its taxes.

  • Unrestricted taxable persons resident in the country or resident in the country.
  • Duty begins with birth and ends with death.
  • Taxation in Germany is subject in principle to all domestic and foreign income of the taxable person.

As long as you don't do this in a big style, you don't have to worry about it. Otherwise you have to register a trade. You would have to be 18 or the business would have to run over your parents.

No, not quite correct. The income must be taxed only when the fixed amount is exceeded by currently €10,908 per year. Everything that is below is tax-free, including the so-called mini or 520€ jobs.

You're registering a business because it's a business thing. But since you're not 18 years old, you'll have to wait.

You are best advised by the IHK in your area. There you will get all the information you need.

It's called TRADE. And, of course, is taxable. You have to register a business for it. And you must be 18
