Sold car privately and now buyer wants to return car because it's acting crazy?

Hello, I have a problem with the buyer of my car. He has been driving for a month and has done about 2,000 km and now the car is acting up.

Now he wants to give the car back to me and get all his money back.

Is he allowed to do that because it was a private sale and the purchase contract specifically states that there is no warranty or guarantee.

You don't have to agree to return the car. He bought the car and that's it. Driving it 2,000 kilometers and then returning the car and demanding the full purchase price back won't get him anywhere.

Since you have obviously ruled out everything and the whole thing was a private sale, and the buyer has already driven about 2,000km, he can forget about returning it

The buyer must first provide reliable evidence of several things

  • The vehicle is on strike due to a defect that already existed at the time of purchase
  • You as the seller of the vehicle actively knew about the defect
  • The defect was deliberately concealed with the intention of making a profit or increasing profit

Proving this is extremely difficult.

Basically not.

The only exception is if the vehicle has defects that you conceal from the buyer. If the car has been acting up in a similar way before, the buyer would be in the right to request a refund. You would then be entitled to some compensation for the mileage driven.

No, he can forget it. He can threaten me with whatever he wants. I'd only worry if he showed up at my door with an AK.

Someone with an AK will probably be better off, as they can aim, pull the trigger, and control the weapon's recoil.
