Pregnant during probation?

Pregnant and nursing mothers in Germany are very well protected and secured by the Maternity Protection Act. This allows them to continue to be active as far as it is responsible.

The aim is also to provide a pregnant worker with safety for her and her child.

Your employer is responsible for implementing maternity protection and employment ban.

It shall be taken into account in the knowledge of pregnancy and shall, on the basis of its risk assessment and usually in cooperation with the operating physician or the supervisory authority (e.g. the Trade Supervision Office), examine, adapt or, where appropriate, issue a job-related, general employment ban (i.e. without a special medical certificate) outside the maternity protection periods.

A risk assessment of the workplace must not be created only when the worker tells about her pregnancy, but must already exist in advance. You can see these.

These include, for example, work with hazardous substances, increased risk of accidents, heavy lifting, permanent standing, chord work, etc.

The employer can also transfer the pregnant woman to another department (e.g. office).

The prohibition of employment in the framework of the Maternity Protection Act begins in Germany six weeks before ET and ends eight weeks (e.g. twelve weeks in early and extrabirths) after release.

After the birth, there is an absolute ban on employment – even if you wanted, the employer must not deal closely – even in the home office.

In contrast, the mother will be allowed to be employed six weeks before birth if she has explicitly stated that she wants to continue working.
