Hello, I have a moped license and a speed limiter for 25 km/h. But it's not registered with the TÜV. The papers say 45. If I get checked, what kind of penalty would I get?

Wenn die Bauart Gewähr dafür bietet, dass die Höchstgeschwindigkeit auf ebener Bahn nicht mehr als 25 km/h beträgt, dann ist das Fahrzeug fahrerlaubnisfrei.
Die eingetragene Geschwindigkeit ist fahrerlaubnisrechtlich nicht relevant, es besteht aber der Verdacht einer Straftat und das Fahrzeug wird auf deine Kosten zur Begutachtung sichergestellt, du kannst aber nicht wegen einem Verstoß gegen §21 StVG verurteilt werden.
