Roller läuft knapp 70 mit alter ABE?

Hallo zusammen,

Meine Freundin hat sich einen gebrauchen Roller (Aprilia) gekauft. Nach dem Kauf auf dem Weg zur Tankstelle ist aufgefallen, dass der Roller (ABE von 1999) knapp 70 kmh laut Tacho fährt.

Wie verhält sich das jetzt. Sie hat nur den Führerschein Klasse B.

Der Verkäufer hat versichert, dass an dem Roller nichts verändert wurde und dieser schon ab Werk mit den originalen Papieren (diese sind dabei) so zügig fuhr.

In 1999, the vehicle is allowed to drive 50 km/h, §76 FeV, and the Tacho is still doing something. There is no legal tolerance, individual case decisions such as those of OLG Karlsruhe have 20% deviation with unaltered vehicle Adopted.

this already worked with the original papers (these are included) so fast.

Little credible, but if this is the case, there is a serious shortage at work, which leads to the fact that it has to end the journey with the defective vehicle immediately after becoming known and has to remove it from the public transport area.

The buyer has carefully concealed the defect, has admitted it only after becoming known, would therefore actually be responsible for the rapeseed, but you can probably not prove it, so you are likely to be on the repair costs.

If (also by a pre-owner) the permit is cancelled. This also jeopardizes insurance protection.
