Restaurant Hausverbot weil sie sich selber Trinkgeld gibt?
Hallo, könnt ihr mir sagen was da vor sich geht?

Ich war am 05.01.2025 19:45 Uhr dort. Das erste, sie haben 1,15 std. früher geschlossen als online angegeben. Ich hatte einen großen Cappuccino (5.95€) bestellt und musste ihn unter Zeitdruck austrinken und wurde sofort zum zahlen gebracht. Beim bezahlen hat die später herausgestellte Chefin (50-60J) sich selber Trinkgeld gegeben, da ich jedoch zum Zug musste hatte ich es per Apple Pay als Nachricht erst später gesehen.
2 Tage später hatte ich eine Kellnerin auf die Situation angesprochen da man vielleicht erst ab einem bestimmten Betrag mit Karte zahlen kann, war auch so, sie antwortete nur „ja, erst ab 15€“ deswegen wurde anscheinend der Rest addiert so das es 15€ ergibt…nirgendwo stand, oder wurde erwähnt das man erst ab einem bestimmten Betrag mit Karte zahlen kann, ich selber konnte den zahlungs Betrag nicht sehen und dachte ich zahle normal den Cappuccino, daher denke ich eher es war ein Versuch sich selber Trinkgeld zu geben.
Ich konnte das Geld nicht irgendwie zurückbekommen aber ich wollte auch nur nachfragen und dann war alles ok und die Situation für mich geklärt. Die eigentlich freundliche Kellnerin wollte mit ihrer Chefin telefonieren um alles sicherzustellen.
Bis dahin war alles gut.
Nach etwa 15 min kam eine ältere „Gestalt“ in den Laden rein, was die Chefin war. Sie kam sofort zu mir und hat mir das gleiche was schon geklärt war, 1 Minute vorgetragen und meinte ich soll sofort mein, nach der geklärten Situation bestellten Cappucino bezahlen, ich stehe auf und sie redet weiter und jetzt kommt es.
Es wäre „unglaublich und respektlos“ in so einer Stadt und in so einem Café kein Trinkgeld zu geben (es war ein ganz normales Café), ich soll sofort bezahlen und mich nie wieder blicken dann meinte sie während sie den Kassenbon gibt, ich hätte „permanentes Hausverbot“ ich war geschockt und habe auch nix gesagt. Als ich meine Tasche genommen hab, habe ich kurz gefragt ob die Situation von der Chefin falsch verstanden wurde, daraufhin meinte sie „gehen sie sofort, ich will nicht diskutieren“
Ich denke mal sie hat eine Art von psychische Störung, weil anders kann ich mir dies nicht erklären.
Kann man da rechtlich vorgehen?

Book it as an apprenticeship and rely on it. The money is not worth the trouble, even if you’re right.
The ban on house is not justified in any way, but you can show it more for fraud. Because that was definitely fraud. Wouldn’t want to go there anymore.
Of course, tipping is common, but there is no obligation to do so. And 5.95€ for a large Cappucino is really quite expensive, because you can’t expect a big tip anymore. I wouldn’t give more than €6.50.
15€ at 5,95€ bill would be 152% tip and so much no one gives.
I don’t know if there was any ticket payment and Apple Pay is only possible from 15€. But if at least you had to offer a voucher for the rest.
The house ban is not really vulnerable as she has as boss house law can let her in or neither let in who she wants.
what you could do would be because of the too much paid money from the first time but also here you will have it hard and you have to wonder if the anger and the costs are significantly above the disputed value you are worth.
Just forget about this and get the subject off or are you going to put life energy in there?
