The running away is not explicitly allowed, but it is not forbidden. This means that if you take the flight, you will not be punishable. Even if you don’t manage to escape and you get caught, you won’t be punished.

Whether you get away from it in a specific situation, if you run away from the police, depends on whether you are resisting. For example, if the police officer asked you to show your identity card during a demonstration and you run away, this is a form of resistance that can be punished according to § 113 StGB.

Likewise, if you are violently trying to get rid of the police’s access. Even if the attempt to escape is linked to a merely verbally expressed violence, you can be prosecuted for this in accordance with § 113 StGB, as this is evaluated as a resistance.

Whether it is a mere attempt to escape or resist the police, depends on the interpretation of the situation. In any case, you should be aware that you will also be persecuted during a non-criminal attempt to escape and will usually get caught.

By running away, you seem suspicious at the moment and will have to adjust to the fact that the police officers will stop you – possibly rather inappropriate. So you should consider if you want to risk a flight.

A lot of nonsense here. In principle, everything is allowed which is not explicitly forbidden and there is no law that prohibits escape. It is not even forbidden to escape from a prison.

There are problems only when you commit crimes or offences on the flight.
