Property violence parents?

Hi,

Parent owns house. Father beats mother. Divorce drags on because husband refuses to separate.

Mother because of father, already been in a psychiatric hospital due to severe depression.

Mother can't stand it anymore and wants her husband to leave the house, but he doesn't.

How is it possible to legally get him out of the house if he doesn't want to leave?

I think that's possible, but I'd definitely advise you to support the lawyer.

Lawyer. You'll need one for the separation. Talk to a lawyer.

Has this marriage been recognized in Germany? Then you can also be divorced here. Depending on what country it is, this may be the much better option for your mother.

Then just a lawyer. One who can tell you what happens to the house after the divorce. It may have to be sold anyway.

Sue him. With a lawyer on your side, you can handle it.

So basic: If your father beats your mother, she should call the police. This can prove to a violent person in a common apartment of the apartment and prevent the return of up to 10 days.

These 10 days are meant to give the victim time to request orders in court in accordance with the Civil Protection Act (GewSchG).

Problem is, wedding was abroad, and there it's totally moving into the length.

The question is whether this is a marriage recognized in Germany. Then it is not necessary to leave the marriage abroad.

Basically, however, your father will not simply be expropriated from the house in the course of the vaginas. One party will have to pay the other over its share or the house will have to be sold. (A common solution such as renting and then dividing the rental income or paying a correspondingly reduced rent of a party to the other party seems rather unrealistic in the constellation.)

If she doesn't go to the police and makes a complaint about injury, not at all.

The police can refer him to the house for a few days.

If she doesn't want to, she'll have to pack the bags. What exactly that looks like with the house you have to ask a lawyer.

Because the mother wants the divorce, she must have a lawyer. This will inform them sufficiently about the possibilities.
