There are now various things to consider:
1. Whether your fault or not, you are responsible for being able to completely present your ticket/railcard etc. at any time, whether digital or analog, it is in principle pure from the regulations and your signed contract completely no matter who has fault. Because you are, if such a case appearance is responsible for ensuring that it is just fixed. For example, talk to the respective company, i.e. here DB, before the next trip where you would need to call or just walk past the travel center and ask for help and otherwise have a certificate or similar issued. If you don’t do that, you didn’t do everything you could, and that’s why it’s your “school.”
Two. Now away from the regulations, but to the human. None of his colleagues, except he/she really has a bad day, will cause you problems as long as you can present a confirmation of purchase with your name and the validity period of the Bahncard, plus any ID or similar. It should usually be enough if you’re nice and quiet to explain the situation!
3. If this is not enough for the colleague, then of course he has the right to write you down according to the regulations because you do not have a valid ticket. If this happens, stay friendly and quiet. He’s just doing his job and he’s completely right. You then have 14 days and can try to get the Bahncard back in time and then submit it. Then you still pay something, but the processing fee is only €7 instead of €60 without ticket.
I hope that helps!
Greetings and always good ride,
duncan
Thanks for the information. Unfortunately, the test track card is not the same – it is only digital (just like the regular railway card). 7 Euro is not much, but I wouldn’t see to have to pay if it blew the train… Tonight there will be maintenance work on the web site – maybe they will do it the same at the app – I hope so. We don’t have a travel center. I don’t know if this is already open in Nuremberg before my next trip (when I have to change in Nuremberg) early in the morning. On the subject of “all done what is possible to you”: what is possible to me, I do, but the train does not leave much possibilities to you. Support on the phone is also not accessible and if you fill out and send out the contact form on the website, there is also an error message… If I have done everything possible (which is obviously not much what I can do), then I already see it that the train is responsible. I can’t reprogram their app…
Yes, you can do what is in your power. The railway cards are only digitally displayed (total vulnerabilities…).
Yes, you will find out about the travel center and otherwise if it doesn’t have to look at the time when the DB Service Point has, they usually have up earlier than the travel center.
Yes the 7€ are easy to pay in the case. I know is not nice, but better pay than not pay and then get stress with reminders and others, because, as I said, purely contractual, this is just completely correct.
Whether this 7 euros in a case where you have just done everything you can, are not to be paid, because it is then 100% the fault on the part of the company, would probably only be to settle with attorney and court proceedings, so whether in such a situation the contract you have concluded does not intervene. This is much more expensive and also more expensive than this doofen 7€.
In Nuremberg, they seem to have open from 7:00 – that should work. To the 7 Euros: I have legal protection insurance and would have to pay it out of principle. Would cost me 0 euros. The railway simply deserves it and has no other way. I’m just driving with the train for environmental reasons and not because I find the company so great. If, however, they just try to get me wrongly money, then it was my last ride and I’m getting back to the car (which I still need anyway, because the Öffis are not extensively developed).
