The withdrawal of cosmetics only in the unused state – A remote cancellation notice with the statement that cosmetics are withdrawn only in an unused state is uncompetitive.

Editor:As a result, the court has left open whether, for example, the opening of the primary packaging already constitutes a “use” of cosmetic products delivered in the far-offset, which goes beyond the possible and patient use in the shop, if the consumer, due to lack of other testing possibilities (e.g. test product in the shop) can otherwise not give a direct impression, e.g., of the fragrance or the skin compatibility of the cosmetic. Since here a general, non-differentiating exclusion of the return was included in the cancellation notice, such distinctions did not occur in the court’s view.
