Package tour entry denied? Compensation?

Dear community,

I had actually planned a trip on Saturday, June 25th. I booked a 6-day trip to Antalya.

All well and good…

So the two of us flew to Turkey with the relevant documents, but when we arrived there everything went wrong.

We were denied entry at passport control. My companion had a passport that was valid for another two months or so, but according to the police, it should have been valid for five months.

The Foreign Office said you could even enter the country with an expired passport…

As I said, we were denied entry (including me) even though my passport was still valid for two years, so I could have made the trip alone…

We were then put in a cell and held there, after which we were flown back to Germany on two different flights. I wasn't allowed any food or drink, only my companion.

While we were sitting in the cell, I called the consulate, the tour operator, and the tour guide who was supposed to meet us at the airport.

Consulate couldn't do anything….

I explained the situation to check24 and they told me to come home and rest.

I told the tour guide that we couldn't go on the trip because we had been denied entry.

My question is: Are we entitled to a refund? Not the entire price, of course, but a portion.

We only used the outbound flight and we never saw the hotel and the return flight… because we had to fly back at our own expense.

Because I could have gone on the trip, but I was not allowed to go to Turkey.

The trip was quite expensive and it would be a shame if the money were gone now.

Are we legally entitled to a partial refund?

The travel agency was ITS Reisen. Booking was made via check24.

No claim against the tour operator (except for taxes and fees which are saved due to the non-return flight). For the completeness and correctness of the documents required for entry, the traveler is always responsible.

What state authority does your accommodation possess? The fact that a passport may have expired for up to one year applies only to a few sovereign powers.

If the Tunisian authorities have dismissed you unfairly, you can try to sue them for damages. But it's probably a lot of hopeless.

The small print determines that you are responsible for the correct passports and entry. The statement from the AA that you can travel without a valid passport is unimaginable for me. Do you have a link to it or was that a (reliable) statement on the phone?

arrests and refusal to enter

There are also cases in which German nationals are arbitrarily arrested, covered with an exit lock or prevented from entering Turkey. Persons who have been able to enter and leave in the past without any problems can also be arrested in the event of a renewed stay due to late or new accusations of action.

I don't know if you can apply for compensation, but:

Entry can also be made with passport, provisional passport, identity card or passport if the document has expired for a maximum of one year

Entry and import regulations for German nationals may change in the short term without the Federal Foreign Office being informed of this beforehand. Please inform yourself in advance of the representations of your target country. Only there will you receive legally binding information and/or information on the entry and customs provisions of your country of travel beyond these references.

The Federal Foreign Office says even more:

German nationals, in particular persons with close private and personal relations with Turkey, have been denied entry in numerous cases since the beginning of 2017 without notice of the reasons. Persons affected had to return to Germany after a waiting period of several hours until a few days in custody. The reasons for refusal of entry are not communicated in principle. Nor should it be excluded that there is a connection with anonymous denunciations. A high proportion of the rejected had a Kurdish or Turkish-Alvitian family background.

There is no right to enter foreign countries. Just when the documents are not in order.

Here too the AA:

  • Take care of valid identification documents before traveling to Turkey.

You can try the tour operator if it was a package trip.

Denied visa and refused entry on vacation

For a flat-rate trip, there are slightly different regulations. According to ยง 4 BGB-InfoV, there is an information obligation of the tour operator. This must indicate to travelers the applicable entry requirements. If he leaves these instructions and the traveler does not apply for a visa, the passenger may demand compensation.

Bad luck! Most of the travel documents are the entry requirements of the holiday country, and it is the personal responsibility of the traveler to fulfill them. Special visas and the like often help tour operators.

However, the fact that a passport document must be valid for at least 6 months is almost part of the general education.

You wouldn't have got any problems with Pass. The fact that at least half a year is valid even if you arrive on foot, not only at the airport. And letting substitute documents go abroad is usually more problematic than before leaving home. The country of entry is not obliged to issue substitute documents to foreigners in contrast to domestic authorities.

6 months of validity, however, is almost part of general education.

Not all countries are calling for that. It is not a flat rate requirement. Each country has its own entry regulations and the sovereignty over whom it enters and who does not.

In the foreign office it was said that you could even enter with an expired pass…

I would like to see that in writing. I'm very interested.

I told myself that we can't enter the trip because we were denied the past.

My question is: are we looking for reimbursement of the price? Of course not the complete one but a part.

Neither the travel agency nor the travel portal have influence on the Turkish customs authorities and can be held liable for their decisions.

What are the claims for refunds is regulated in the contract or in a travel insurance. It is common that parts are reimbursed if there are good reasons before the arrival of the trip, ie the trip has not been made, partly even if it has been canceled (for example for health reasons). The so-called "higher violence" is generally excluded. By your flight, but not appearances, however, neither the travel provider nor the hotel(s) can find short-term replacements. Whether a (safely completed?!) Travel insurance takes over shares, must be clarified directly with them.

the travel price is completely gone, as you have been denied entry, you have to answer it yourself.

Why have you been denied entry? what will be silent?

and what citizenship does your accommodation have? there is something wrong with the documents

because of this you have a problem with entry that has been denied you. The Turkish authorities decide alone, denied entry, so your travel price is falling.

No – because this would be "higher violence" from a travel company's point of view, which has no influence on it.

My accommodation had a passport of 2 months

does your accompaniment have German citizenship?

Do you have legal protection insurance? In my case, there is the possibility to call a free lawyer hotline and get advised.
