Meinem Mann wurde einen Tag vor Aufnahme in der Klinik seine Herz-OP abgesagt.
Wir waren bereits auf der Autobahn zur Klinik. Ich wollte ihn begleiten und hatte für 8 Tage eine Pension gemietet. Diese musste ich nun auch stornieren.
Die Pension verlangt nun den vollen Preis. Wer zahlt den?

first of all, of course, you will have to pay the cancellation fees yourself.
Of course, you can charge these to the clinic as compensation… whether they will pay it – other question. I would rather assume that this would also have to be brought to justice. As here is the prospect of success, I cannot and will not judge that should be done by a lawyer.
From my point of view, the clinic should be able to plan its capacities for planned interventions at an early stage. If a cancellation takes place on the day before the surgery, it should be assumed that the staff ceiling is too narrow and not planned with the proviso of a cautious merchant.
Can you prove that? Did you document it?
If this is indeed the case, a cancellation fee in full is not legally stable. A cancellation fee is legally a compensation. This follows: No damage – no damages.
This is to be demonstrated by you in case of doubt. The pension should certainly require a reasonable package for additional costs… or also provide proof that the new booking had a lower order value and thus a damage occurred.
If you are able to prove this and the pension is crossed, the financial authorities should be informed. For a compensation is a non-controllable performance – so there is no VAT on it… on the other hand, a processing fee for the additional cost of the booking would be charged with VAT – the tax office thus avoids revenue… and many financial offices do not like that at all.
