Transfer Nvidia warranty?

Hi everyone, I'd like to buy a new graphics card on eBay. This one is being resold by a private individual.
The card is still sealed in its original packaging and the invoice in the name of the first buyer is included.
As far as I understand, the statutory warranty is handled by the retailer. This means that the warranty only covers damage that already existed at the time of purchase. So, if the card works after unpacking, the warranty is no longer valid anyway, right?
Now my question is, do I have warranty claims against Nvidia in the event of a claim, or only the first buyer? I haven't found anything on the Nvidia website regarding warranty transfer or binding. Does anyone here know anything?

Nivida is a little misunderstood and the guarantee is called “weighing performance”. According to the Nivida warranty conditions, this applies only to the first cow.

Excerpt from Nivida Warranty Terms: “This warranty applies only to first buyers of a warranty product for a third party authorized by NVIDIA or underhttp://www.nvidia.de; This warranty does not apply to persons who purchase the warranty product used.”
