Does a shipping service provider have to be liable if they lose something rare?
A well-known shipping company lost something I ordered. They refunded it, but because of them, I didn't receive something I could have gotten for MUCH less as second-hand stock, and now I have to buy a new one for much more. Shouldn't they also be held liable for the fact that I now have to pay more because of their mistake?
No.
You get the time value, means what it was worth to the shipping date. If a mobile phone was lost 5 years ago New 1000€ worth, you will not get 1000€ more than damages, but only the price it would cost to buy a used model (if it was needed). This is, of course, clearly lower.
No it is new and it was B merchandise significantly cheaper, but B merchandise is just returning merchandise new. And that was unique. Now I can pay more than twice for new.
But this is how it works, B merchandise is not new, you get the refund you paid for (B-Ware).
Legally, B/Retourware is by the way used.
Depends on whether it was an insured or unsafe shipping…
Insurance
Then the shipping service provider must be liable
Are you sure?
depends on whether only the damage you suffered is insured, or the value of the recovery.
The package was insured
