Is it worth filing an objection if the photos from the public order office are unclear?
Hi, I got a letter today about parking on the sidewalk with a disability.
However, the photo evidence doesn't show that I'm standing on the sidewalk. Is it worth taking action against this, or has the public order office collected more photos?
At least it is currently punished with 100€ and one point.
To all those who now think they're acting holy and write "then don't park on the sidewalk": I wasn't aware that there was a sidewalk there and I parked extra close to the wall of the house so as not to obstruct traffic.
Besides the photos, they have the officers as witnesses and the judge will believe in doubt. In addition, parking breaches are not legally insured, so pay and be happy 🙁
Good advice, thank you!
It may be worthwhile to appeal against a fine decision for parking on the walkway with disabilities if the proof photo is unclear and it is not clear that you have parked on the walkway. However, it is important to note that the Office may have collected further evidence, such as further photos or testimony, that prove your fault.
It is always useful to examine the situation exactly before you object. If you are unsure, you should contact a lawyer who can advise you.
It should be noted that although opposition is able to contest the fine decision, there is no guarantee that the fine is actually reduced or cancelled.
It is difficult to answer. From my wife’s law firm, I can only report that the originals of the images sent to you are often much sharper and you often only get excerpts from it. This means that there is a non-calculable danger in the contradiction that the opposite side has clearly more useful evidence than thought.
Personally, I would pay the ticket if I were aware of a fault.
If you’re in ADAC, you’ll get a free initial consultation at the club journalist to assess the situation better.
So I would appeal.
on the grounds: I was not the driver at the moment in question.
Should If you give me a description of the driver, I can also name it at the moment in question 2 persons.
gr.
road traffic is not obstructed the pedestrians are something of no matter.
Pay the just punishment and learn from it
Sorry, but that’s a pointless and not helpful answer. The FS has now clearly written that he was not aware of having parked on a walkway, so it was not a conscious intention, which implies your answer.
