Du bemängelst die Systemstabilität. Gut, dann kannst du auf Gewährleistung gehen. Aber, der Händler hat das Recht auf Beseitigung der Mängel. Heißt, sollte der Händler dir einfach ein neues Laptop schicken, das alte reparieren, oder es stellt sich heraus, dass es mit etwas Software optimieren getan ist, … gibt es kein Geld zurück. Sofern der Händler kulant ist, bietet er an, den Preis zurück zu zahlen, ist aber nach 8 Monaten eher selten so.
Probiere es aus, reklamiere das Gerät, und warte auf die Reaktionen vom Händler ab.

Ein Umtausch gegen Geld ist aber 8 Monaten definitiv nicht mehr möglich. Wäre schon nach einem Monat nicht mehr möglich.
Verkauf den Laptop auf Kleinanzeigen oder eBay. Vorher solltest du jedoch versuchen die Fehler zu beheben.
Hast du alle Treiber aktualisiert? Sorgst du für ausreichend frische Luft?

Garantie sorgt dafür, dass der Hersteller für den Fehler gradezustehen hat und der Fragesteller ein repariertes System zurückbekommt.
