Classified ads swap, return exchange possible?
A few days ago, I posted a PC I had built myself on the classifieds, whereupon someone contacted me and I traded it for a PS5.
I handed over the PC personally. The information I provided wasn't based on any technical specifications. Now the customer is complaining that the PC isn't good enough and that I wanted to "rip him off." At the meeting, I told him that the PC is suitable for everyday use and can even be used for gaming, but it's not a high-efficiency PC (as it is).
Now he's threatening to file a lawsuit. What can I do? Is his request for a refund justified? We haven't agreed on any other agreements, such as buyer protection.
I cannot advise you legally, of course, but what to consider would be of course, even if there were a civil legal basis, for a re-exchange, damages or the like, there is not a direct criminal offence that can be successfully displayed.
A new ps5 costs around 400€, for which you can not expect a high end gaming pc.
If we don’t know what the pc has for specs or can play for, we can’t evaluate whether the classification “you can play with it” is fair. To enter such a exchange without dealing with the performance itself is of course already stupid.
Make sure that the pc is all right if you take it back in the end before you return the console.
