Paragraph 108(1) of the BGB:

(1) If the minor enters into a contract without the required consent of the legal representative, the effectiveness of the contract depends on the approval of the representative.

Consequently, a floating effect is not possible, since the Treaty is only effective by the approval of the representatives.
