1. The buyer is bound to the order for up to 10 days, for commercial vehicles up to 2 weeks.

Two. The buyer may request to supply the seller for ten days, for commercial vehicles two weeks, after a non-binding delivery date or a non-binding delivery period has been exceeded. With the access of the request, the seller is in default.

3. In addition, if the Buyer wishes to withdraw from the contract and/or claim compensation instead of performance, he must place a reasonable period for delivery to the Seller after the expiry of the relevant period in accordance with paragraph 2, sentence 1 of this Section.

In the case of new vehicles, such a (appropriate) period shall be 14 days.

I’m not a lawyer, but as I understand, you could withdraw immediately if there were no purchase contract according to paragraph 1, but only an order.

If a purchase contract exists, you can now set a period of about 14 days. Don’t think it’s going back.

There should already be a reasonable repair date in the contract, otherwise a timely handover of the car is accepted, such as about 14 days. Set the seller in delay of delivery and it a period of 14 days with the threat of withdrawing from the contract in case of non-compliance.

No, you can’t.

However, you should set a deadline for the dealer in writing until he finishes your car. 5 weeks has been a long time, unless you have agreed something special in the contract.

It can also be helpful to point out that after the expiry of the deadline you require a rental car which he can give you, but he can also pay you.
