Can I be reported for this?

Hi, I'm 14, and about a week ago I had the idea of essentially copying classified ads (I didn't copy them 1:1, I'm actually just selling the same shoe). I'll just add around €10-15 extra so I can generate some revenue. This means that someone sees my ad, writes to me, and if they want to buy the shoe, they pay, and I order the shoe from the original ad. I haven't had any sales yet. Now someone has messaged me and simply said: "I've reported you to the police. Can he do that? Is what I did really illegal? He's not even the actual seller of the shoe." Feel free to contact me with any questions.

In principle, it is not forbidden to buy and sell goods.

For example, it is forbidden to simply use foreign images for the display. So if the original seller photographs the shoes, then you use the same image in your ad, then you have violated the copyright and usage rights. It can be expensive.

And if you do this regularly, then there is a commercial activity that you sign up and on which you may. Taxes should be paid.

Personally, I find your idea quite unwise.
What are you doing, for example, when someone buys a pair of shoes with you, the original provider that has sold now and you can’t buy them anymore?

I also see it problematic when someone offers goods for sale that he does not own. That’s pretty close to the scam…

it’s just drop shopping

You mean dropshipping… no, it’s not. Dropshipping merely means that a trader does not have the goods in stock, but can rely on the stock of another (manufacturer, wholesaler, …). There is a contractual relationship between the dealer and the supplier.

With you, however, it’s like you’re buying goods that you don’t own at all and where you can’t be sure that you can buy them at all and sell them on.

When I saw that the original ad was deleted I also deleted my

Nevertheless, the danger is very great that the goods are now sold elsewhere. Because 1.) is not sure that the original seller immediately deletes the ad, 2.) you will not sit 24/7/365 in front of the computer and respond to the deletion of a ad and 3.) the seller is not obliged to sell to you.

The fact is that with the sale of an article you enter into a legally effective contract with your buyer that you do not know whether you can fulfill it.

In addition, the question arises whether what you do is not even a commercial activity. Because one of the aspects of commercial trade is “you buy articles to resell them” – and that would be 100% fulfilled by you.

This is commercial action.

Get a commercial license. To do this, you need your parents’ consent and the family court.

Yes, he can write you.
yes he can show you.
he can also report you to classifieds.

Your idea is basically not wrong, but has one or the other hook.

It is quite similar to the triangular structure,
and you say with the classifieds that you have something to sell, not that you might then buy it from the other.

What do you do if someone buys you the part immediately, but then you notice that the other classified was closed because already sold?

It’s not a crime first.

ABER: if someone pays and then you can’t deliver, that could be designed as a fraud.

In addition, you could theoretically be liable for damages.

Much worse is that you are not fully operational! You will in any case violate the GTC of classifieds.

No, it’s not a crime. If you can’t get them the goods because the other one has already sold them, it touches civil law.

But that’s nothing like that.

This is how drop box works. But if you use the photos from the other seller, there are problems. The same applies if you cannot get the product.

dropbox is a cloud storage and that doesn’t have the least to do with it.

Stop confused with dropshipping. 🙂

that’s not illegal.

Since you are not 18 the ad will go through, but in the worst case, if at all, will run out to a few social hours.

Under 18 you may not sell or buy

I see some problems with you. It’s starting with what you can’t sell on the site because you’re not old enough.

All the other things will come. You’re really gonna break your future. :

If you are displayed or catched, definitely. :

Of course you can sell the shoe. It’s just questionable if someone wants to pay so much money if he was cheaper there before.
