Is my operating costs statement in the rental agreement legal?

Hello, my rental agreement states that I have to pay the operating costs in advance (€70.00).

When listing the operating costs,

  • Heating, even though I have my own gas contract (perhaps this is related to heating maintenance?)
  • Hot water supply, even though I have my own gas contract
  • Elevator operating costs even though there is no elevator
  • Caretaker costs, although I have never seen a caretaker and the stairwell is rather dirty
  • Garden maintenance, although there is no garden, only a private parking space, which I do not use, as it would otherwise cost me an extra 40 €

What should I do now? My landlord is a limited liability company (GmbH), and everything is managed by a property management company. The guy from the property management company is extremely unpleasant and not at all accommodating. I don't doubt the total amount of operating costs, but this list doesn't make sense. I won't be living here long, but I don't want to be ripped off either. Unfortunately, the contract doesn't specify how these €70 are divided, so I can't understand it at all.

In almost every rental contract, all operating costs are listed, which may occur. Of course, only what has actually happened and that can be checked by any tenant.

Master’s costs: Even if you never see a master of the house, it can still be that a master of the house is employed who takes care of everything possible around the house, but is not responsible for cleaning the staircase.

Look who is responsible for the cleaning of the stairs according to the rental agreement. If this is an external cleaning service, let the house administration know if nothing has been done for a long time, so that they can control it and perhaps monitor it better in the future.

Don’t. Besides the BK you hired, there are more. For example water, waste water, waste disposal, land tax, insurance for house and land etc.

At the moment you don’t have to do anything except wait for the first bill.

Just wait for the cost accounting and then see what was charged.

If, for example, no elevator is present, no costs will be incurred.

The operating costs are not limited to the positions you have listed. There are other costs incurred.

70 euros per month as operating costs are fairly low.

The landlord may only charge the costs he paid during the course of the year. You can check this as a tenant in the owner’s office or the administration after receipt of the operating cost bill.
