Is it legal to kick 8th grade students out in Bavaria?
Hello ,
I'm an 8th-grade student at a high school in Bavaria. Our teacher often throws us out when we misbehave. While I generally view this as a breach of duty of care, I think it's okay for a short time. However, he sometimes throws us out for up to 60 minutes and doesn't allow us to participate in the entire double lesson. Is this okay? Is it allowed for a short time, or is it generally forbidden? Is there a specific law that prohibits throwing us out?
thank you very much in advance
Students must be sent to the Secretariat and supervised there. Simply into the debt building in front of a classroom with closed door violates the supervisory obligation if the teacher does not regularly look after the student.
I was only sent to the door in my life one time, because someone had weakened behind me, making the teacher mistakenly accuse me. She was at 180 anyway, so just hadn’t done anything. I was in the 7th grade.
I went straight home because it was the last hour. Funny then the school called panicky to my mother, who gave the teacher a lecture on the phone first, as she comes to sending a 13-year-old out without supervision. It’s clear that he’s going off.
😄 the ass went up.

Why don’t you just take part in the class?
This rash will not only take place from a whim of the teacher.
Sure, you could open a legal subject right now. But, did you happen to have stood up in the classroom on the topic of “Hebelgesetze”?
As I said, I wasn’t put in the door. Besides, you don’t know the teacher and you can’t assess it, but still thank you for your helpful and objective advice.
This badly masked sarcasm also doesn’t change the fact that you are students at school to learn something. So you want something from school, not vice versa!
The teacher has completed both his Abi and his studies. It doesn’t matter if you’re in the classroom or at the door. In case of doubt, it doesn’t matter if you spend the next school year at the real school.
In your question, you wrote about “us,” make yourself part of those affected. Anyway, it’s in your interest to be able to participate in teaching. So take care of yourself.
Okay, I guess I wrote the question wrong, and I was overreacting. Now seriously meant 😉: thank you
The 8th grade is 14. If you are not obstructed, this is not a violation of the duty to give you an hour alone.
I would say if a fellow student, for example, would get breathless it did not have to be “impededed”
Then she can report. You don’t have to stand 24/7 next to 14-year-olds.
Are your parents permanently in your room at home? I don’t think so.
Thanks again for your support I will take it to my heart. How do you take your information that would be very helpful
No, you just don’t like my comment. Teacher can send you out, basta.
You act like a little child. But still many thanks for your assessment
Yes, of course that is allowed.
By the way, always horny if children don’t stick to rules and then go around because the consequences do not taste them and want to appeal to rules. So funny.
Of course, they leave me alone and of course something can happen. I am concerned about whether my teacher’s behaviour is allowed is not about whether it makes sense!!!!
Again: So your parents are if you’re not in school 24/7 on your side and never leave yourself alone, are you?
I do not believe that a student with such problems is absolutely in a position to report. It is only about the fact that the teacher simply cannot ensure at the moment that all pupils are unharmed, even though this case is naturally unlikely to be allowed to put in front of the door in principle, and not whether it is sensible that it is offered or allowed. And if you don’t know, your comments won’t help
And why don’t you just let yourself be your misconduct? Then you don’t have to face the door!
Behave yourself – is THAT okay?
But I don’t think that’s what I’m doing, but there are also cases where he throws out the pupils he can’t suffer.
Is it allowed that 8th class pupils are constantly disturbing class?
Of course it’s not okay! But there are also other measures, such as a pedagogical teaching exclusion, and since in the 8th grade it may happen that the teaching of pupils is disturbed.
just go away – then he’s got his ass open!
