I was caught speeding?

I was caught speeding on the highway, going 15 km/h over the limit. Today I received a letter asking me to comment. Depending on my response (whether I admit it and why I was speeding), I may be fined.

What should I write there? It doesn't really matter, I have to pay anyway, right? Because I don't think that if I write "Sorry," I won't get a fine. 😀

So why not just issue a fine? The penalties are already set in advance for each violation, so what's the point?

Because we live in a constitutional state and therefore the person concerned/accused has the right (not the obligation) to comment on the facts of the case before a decision on a punishment is made.

This serves to protect the person concerned/accused from unjustified punishment.

This principle also applies in simple cases such as a clearly committed speeding offense.

In most cases, minor offenses are subject to a hearing and a fine offer, which allows you to pay the fine immediately and thus resolve the matter without a hearing. However, this is not always the case, as this is at the discretion of the authorities.

And only if you don't agree do you have to fill something out and send it back…

If you agree, you don't have to respond at all. This is for example, if you weren't the driver, etc.
