How is parental allowance calculated in my situation?

My son was born on September 11, 2020.

I was a single parent from the beginning and took three years of parental leave.

Since I worked for the 12 months before the birth of my child, my parental allowance was calculated based on those 12 months.

When the parental allowance ran out after the 14th month (2 months maternity allowance + 12 months parental allowance), I had to apply for ALG 2.

Now I have the following question:

Suppose I were to become pregnant now, while still on parental leave for my first child, and expect my second child in the fall of next year – how would parental allowance be calculated this time?

Is unemployment benefit 2 considered income, and the next parental allowance calculated based on the last 12 months of unemployment benefit 2? Or, because unemployment benefit 2 is not considered income, are the last 12 months before the birth of the first child used as the basis for the calculation?

Grundsätzlich werden zur Berechnung, genau wie für Kind 1, die letzten 12 Monate vor der Geburt von Kind 2 herangezogen.

Es gibt bestimmte sogenannte “Ausklammerungstatbestände”, die bei der Berechnung nicht berücksichtigt werden. So kann es sein, dass auch noch einige Monate von vor der Geburt von Kind 1 zur Berechnung des Elterngeldes für Kind 2 herangezogen werden.

Zu diesen Tatbeständen gehören der Mutterschutz und die ersten 14 Lebensmonate von Kind 1, wenn in diesen ersten 14 Monaten Elterngeld bezogen wurde.

Wenn dadurch weniger als 12 Monate bleiben, werden auch Monate von vor der Geburt von Kind 1 mit in die Berechnung einbezogen.

Aber in deinem Fall würden deutlich mehr als 12 Monate zwischen der Geburt von Kind 2 und dem Ende des 14. Lebensmonats von Kind 1 liegen, deswegen kommen Ausklammerungstatbestände nicht zum Tragen.

ALG2 ist kein Einkommen, von daher gäbe es bei Kind 2 nur den Mindestsatz an Elterngeld, und auch keinen Geschwisterbonus. Den gibt es nämlich nur bis zum 3. Geburtstag von Kind 1.
