You have as good as bare possibilities to decriminalize it. The problem is simply that the inclusion of asylum seekers cannot necessarily identify the culture they belong to. This means, for example, that for some of them self-justice in certain cases is something quite normal and they then wonder that they are accused of murder.

Whether this guy belongs to IS, you don’t know that exactly. The IS is, however, very pleased that the action was carried out. That’s how they managed to get the press panic. This guy, however, has attacked other citizens without choice, so his deed cannot be attributed to cultural backgrounds.

The next problem is the deportation. According to the report, the perpetrator should be deported to Bulgaria. Bulgaria wanted to win this. However, it did not work because, according to the Dublin III regulation, a period of six months applies where the deportation has to take place, in precisely the European state in which the citizen had first arrived. This time limit was probably already extinct, otherwise Bulgaria could have already taken up the citizen.

There are also exceptions for this regulation, for example if such a citizen whose deportation is to be done is “volatile”. Thus, it opposes the deportation within the time limit. According to the Federal Administrative Court, however, a one-time “non-attack” of the citizen in his estate is not sufficient. The citizen is also not obliged to actively participate in the deportation.

Let’s get back to our case: how was it going? He filed an asylum application, which was not rejected, but also not properly examined, because Germany declared itself not competent. Because the citizen was in his first European entry in Bulgaria. So now it’s time to clarify whether he had resisted a deportation before. For in 2023 a deportation could not take place because the authorities had not found him in his estate. So the question is now: can it still be thwarted as an extension to 18 months? We may be curious how the case continues.

In the end, one cannot prevent such deeds. Radicals, frustrated and crazy there are always: See Hanau, Halle, Hamburg, Berlin, Würzburg, Schweinfurt, Rot am See, Munich, Münster, Trier, Erfurt, Winnenden et al.
