Got a car radio that says it has DAB, but the radio doesn't have DAB and has already been installed in the vehicle?

Hello everyone,

I had a car radio installed that didn't have DAB reception. According to the online retailer's description, it should have DAB reception, and I bought a new radio specifically for that reason.

Well, I had a family member install the radio and paid €40 for it. The dealer, of course, admitted his mistake and would take the radio back.

What is the legal situation and also experience if you install something that only later turns out not to have the desired function?

§ 439 BGB, subsequent performance

(1) The buyer may, as subsequent performance, demand, at his discretion, the removal of the defect or the delivery of a defect-free item.

(2) The seller shall bear the expenses necessary for the purpose of subsequent performance, in particular transport, travel, labor and material costs.

(3) If the buyer has installed the defective item in accordance with its type and intended use into another item or attached it to another item before the defect became apparent, the seller is obliged, within the scope of subsequent performance, to reimburse the buyer for the necessary expenses for removing the defective item and installing or attaching the repaired or delivered defect-free item.

(3) dürfte schwierig werden wenn es “privat” stattfand ohne Nachweis, Rechnung o.ä. 😉
