Führerschein in Spanien trotz MPU, ab wann zählt die Residencia?

Hallo zusammen!

Ich lebe seit November letzten Jahres in Spanien und habe nun vor meinen Führerschein neu zu machen, da ich meinen vor knapp 2 Jahren in Deutschland verloren habe aufgrund eines Autounfalls verursacht durch vereiste Straßen bei dem anschließend bei einem Bluttest Cannabinoide nachgewiesen wurden, weswegen ich nun in Deutschland die MPU machen muss(obwohl die Werte des THC’s im Blut unter 1ng/ml lagen..).

Nun habe ich vor meinen Lappen neu zu machen aber besitze noch keine Residencia weswegen meine Frage aufkam wenn ich diese nun beantrage zählt dann mein offizieller Aufenthalt ab dem Zeitpunkt der Beantragung der Residencia, der Ausstellung oder ab dem Zeitpunkt seit dem ich im Land lebe(Beginn meines Mietvertrages). Denn ich muss 185 Tage im Land gemeldet sein um trotz MPU meinen Führerschein hier machen zu können.

Ich hoffe jemand kann mir mit meiner Frage weiterhelfen und ich würde mich über jede hilfreiche Antwort sehr freuen. LG

There is a very complicated rule in Germany. I’m gonna save it in your word. But in principle, this means that it is assumed that you have moved your food point to Spain when you stop there for at least 185 days. This should be regulated across the EU so that you can then make a driving licence in Spain.

This would also be valid worldwide – except in Germany.

No, that’s possible. The condition is that the lock had expired at the time the Spanish driving licence was purchased. I don’t know how this is with the MPU.

Good advice, thank you! I think that is true of paragraph 5. An application must be made, but it will be positively divorced when the lock has expired. The prerequisite is that he started practically completely at zero.

How is this to be understood?

1. Exclusion of the domestic driving authorization from § 28 para. 4 sentence 1 No. 3 FeV (juris: FeV 2010) takes place on the basis of the advance of application of the obligation to recognise Art. 2 para. 1 of Directive 2006/126/EC (juris: EGRL 126/2006) no application, if the person concerned received a driving licence in the Member State of his ordinary residence after the expiry of the blocking period in Germany, the issue of which, in accordance with the requirements of Directive 2006/126/EC, requires the examination of the driving suitability. (Rn.13) This also applies if the person concerned has been deprived of a driving licence of classes A and B in the country concerned.

You only need to apply if there is a lock or a lock, otherwise not.

This is to be read in § 28 (4) No. 3-5.

So do I get that right? If I get a driving licence in an EU state, do I have to apply for it in the Federal Republic of Germany?

No, it was already passed through to the ECJ. This has decided that the driving licence should be recognised, but only if it is requested.
