I don’t think you have to explain the difference between video and photo?

It was even explained in short. As part of an ad (against the wrong parker), photography is allowed. The same applies in an accident and/or other events.

Only Dashcams always record video material to have video material available in an accident even before the event.

The official statement for this:

According to the Federal Data Protection Act (BDSG), the unnoticed filming of drivers and pedestrians on public roads is an intervention in the informational right of self-determination and thus inadmissible. An observation or Recording by means of a dashcam only to the extent that no protective interests of affected persons prevail (§ 4 BDSG).

Nonetheless, every police officer on site and also the opposing insurance will take your Dashcam shot with kiss hand.

“Only allowed” is therefore really far brought in. In many cases, the video material is included as proof.
