Fahren ohne Führerschein bzw. Lenkerlaubnis (Österreich)?
Hallo erstmal,
gestern war ich mit einem Bekannten in unmittelbarer Nähe meines Wohnsitzes auf seinem Moped unterwegs. Er ist gefahren, wir hatten beide einen Helm auf, soweit hat also alles gepasst. Als wir dann auf einer Landstraße weit entfernt von jeglichen Häusern oder anderen Straßen waren, stieg er ab, um mich mal aufs Moped setzen zu lassen und vielleicht den Motor im neutralen Gang aufheulen zu lassen. Es war nie geplant, dass ich fahre.
Plötzlich kam die Polizei um die Ecke. Diese sah, wie ich eben auf dem Moped sitze, mit noch ausgeschaltetem Motor. Die beiden Polizisten stiegen aus, befragten uns beide ein Wenig, und drückten mir schließlich eine Anzeige auf Grund des “Fahrens ohne Führerschein” an. Ich habe bereits versucht, nachzulesen, was denn die genaue Definition dieses Gesetzes ist, allerdings konnte ich nicht das herausfinden, was ich wollte.
Nun ist meine Frage: Haben die Polizisten richtig gehandelt? Ist diese Anzeige berechtigt? Ich bin wie gesagt, weder gefahren, noch war der Motor an. Ich bin nur auf dem Moped gesessen. Mit Helm auf.

I just came back to this question, wanted to tell you how it went! Objection raised, simply said I didn’t drive without further information, letter of the bra came back: ad immediately withdrawn, without comment! No warning, no penalty, garnix 🙂

The engine was out, as I said. In order to blow up the engine, it should have been allowed to run, of course, but that had not happened yet!
