Parental leave and Christmas bonus?

Hello dear community, I need your help again 🙂

This year I am going on parental leave, from

11.08.2024 to 10.09.2024 and 11.10.2024 to 10.11.2024

My question is, do I get a Christmas bonus?
The following extract from our collective agreement:

  1. The right to a Christmas bonus only exists if employees have been continuously employed by the employer since September 1 of the same calendar year on November 15th.
  2. There is no entitlement to a Christmas bonus if the employment relationship is suspended on the reference date of November 15th or if employment has not been carried out for more than 12 months at that time.

Now my questions:

If I'm on parental leave, am I still continuously employed? What exactly is the distinction?
As I understand it, I get a Christmas bonus for the times mentioned above…

Vertraglich, gibt es das noch? ansonsten muss es gezahlt werden.
