eBay buyer protection case closed without a return. What now?

Good morning,

I recently bought an iPad on eBay from a private seller. It was described as "like new," but arrived with heavy signs of wear and tear, including a display defect. I then asked the seller what we should do, to which he denied having sent the iPad in that condition. He also continually called me a "fraudster," "scoundrel," etc., and threatened me with legal action. So, he acted the whole time as if I was the one cheating on both of us…

So I contacted eBay to request a return. This worked, and the return was approved. The seller then had five days to send me a label, but he never did.
After these 5 days, I received a refund from eBay – case closed.

My question now:
Do I have to send him the iPad back now? I'm a really nice and fair person, but I don't begrudge people like this seller a loss of several hundred euros. He treated me like dirt, even though HE'S the one selling tech products with significant defects as "like new"…

I’m sorry you hit such a salesman. Unfortunately, this is not a rare thing on eBay, so I don’t order any devices there.

In this case, I would just keep the iPad and turn to eBay again.

What happens if the seller does not send the receding within these 5 days? Is that clear?

You can’t keep the article and since you get the money back, the Ipad belongs to the VK again because you’re supposed to send it back. Even if he was very unfriendly it does not mean sending it.

Write to the VK again with the request either to send you a shipping chain, to pay you the shipping costs in advance or you could also send him the shipment unfree. And if he does not report within a certain period, you will send it unfree. Because you want the VK to get his article back and you can make sure that’s what’s going on!

Give him a week to react and he will react safely because if you send something unfree it will be more expensive for the recipient and he must accept the show.

Since you got your money back with the rewind, the VK gets its device back. If you want to keep it, you have to pay it again, but money back and keep articles is not going.

You have a purchase contract – both of you have to stick to it. The seller has to make the thing available and you have to pay the purchase price.
