Ordered an e-bike from another EU country?
Hey,
I ordered an e-bike for €2,600 in the Czech Republic. Shipping of the pre-assembled e-bike cost €120.
Unfortunately, when the bike arrived, I could only ride it a few kilometers; the battery seemed to be defective. I informed the seller, sent pictures and videos, and we agreed on a return shipment. The seller paid for it. Because of this, the shipping company that was supposed to pick up the bike was a day late and didn't arrive at the agreed time, so the bike and its box were left out in the rain for a day.
About a week later, the bike arrived at the seller's office and he said the package had been punctured and had visual defects.
As I said, I took pictures and videos of the bike before it was returned, and there is no damage visible.
Now the seller has refused to refund the shipping costs. He only refunded the e-bike. So, €120 is missing.
As far as I know, the seller is liable for damages during return shipping within the EU.
How do you see this?
Multiple emails have not helped. Should I file a report?
Why advert, I don’t see a crime far and wide.
The main problem should be that the carton was completely softened. You’ve been violating your due diligence.
It was agreed that the e-bike should be picked up on a specific day, this was cancelled by phone with the forwarding.
But they are without letting me know when I didn’t come home and picked up the bike the next day. In my opinion, this is not my fault if the forwarding that should pick up the bike does not appear unannounced.
Well, but it’s already (d) Risk that you see, your bike is apparently packed and unattended to put in front of the house and accordingly do not get along if it is not picked up or gets picked up by someone wrong or then you are standing in the rain. Especially since the two-wheeler obviously stood there the next day – unnoticed or just ignored by you.
Yes, since there was obviously a damage to the bike, the return must be carried by the seller.
Do you have a document that proves the damage-free transfer to the forwarding? Otherwise, you have bad cards and no proof that the bike was handed over intact. In addition, of course, the delayed pick-up does not allow you to leave the dispatched goods in the rain for 24 hours. I can understand the annoyance about the non-complianceed date, but that this will make the packaging pass through, and accordingly is no longer stable enough for shipping, explains itself. This is ultimately your duty of care.
120 € for shipping, the dealer cannot, of course, retain a part of the purchase amount with corresponding deficiencies on the returned bike, which go beyond the battery and over easy normal signs of use, he can already retain.
Edit: You can forget an ad, which is why you want to refund it? This is the problem if you (probably) order abroad, then you hardly have a handle when there are disputes. I must also say here that I see the error with the resulting impairment more with you, as I understand the story here.
Your money has flown.
