Dhl schadensersatz abtretungserklärung?
Ich bin etwas verwirrt bezüglich einer abtretungserklärung. Ich hab vor einiger zeit ein handy bestellt und habs während der rückgabefrist zurückgeschickt. Allerdings ist das paket beim verkäufer beschädigt angekommen ( originalkarton da handy weg ). Jetzt hat dhl geschrieben, dass sie mir den schaden erstatten allerdings nur wenn ich so eine abtretungserklärung unterschreibe. Dazu haben sie das geschrieben.
“Mit anderen Worten: Wir werden Ihnen Schadenersatz in Höhe des Bruttobetrages leisten und später die Mehrwertsteuer vom Verkäufer einholen.”
Weiß jemand was die mit “die mehrwertsteuer vom verkäufer einholen” meinen ?

The seller is commercial. This means that the resulting damage is the net amount. In case of a sale, the seller would have deducted the VAT which he received from you by payment. The sale didn’t come, so he doesn’t do anything. However, the seller still has the money and should at least pay you back the VAT. His damage is “just” the net amount. Since DHL has replaced you the gross amount and therefore the repayment of VAT has been made for the seller, you will be entitled to repay the VAT to you. I hope that was quite understandable 😉
