Can you list a rented storage unit as your business address?

Hi, a friend of mine wants to register his business (an online shop that packs and ships parcels). He's reluctant to use his home address because he doesn't have enough space there, and it probably won't work with his landlord. Is he allowed to rent a storage unit, such as MyStorage, and list it as his business location? His mailing address is still his home.

Does this work?

Can you use another address instead of your own private address in the imprint? Yes, because it does not matter that you use your private address in the imprint. Rather, it is a chargeable address that must meet certain requirements.

For example, I have a photo studio and rent addresses for such cases… with telephone service.

Yes, he only has to specify the rented address anywhere.

The mail is forwarded to the “real” address twice a week in a collection envelope or picked up.

Yes, it’s not about registering, it’s about the imprint and the letterhead… so contact with strangers and customers.

This is, of course, wrong. It is permissible to rent such business addresses… This does not save you from registering the actual premises (§ 14 GewO).

  1. I do not think that the terms of use of the storage space renter will allow you to operate there.
  2. All establishments must be displayed at the trade office (main office, branch offices, non-resident branch offices).
  3. In the imprint, the address under which the company established is. And the branch is derived from the commercial register or commercial registration. So business mail goes home only if you registered your branch there.

Wrong. It is not necessary to specify “a chargeable address”, but the address at which the company is established (§ 5 para. 1 TMG). This is the address of the branch, not registered in the HR.
