Can I file for personal bankruptcy if my debts arose from criminal offenses?

For example, if I drive under the influence of drugs, have an accident and harm someone financially and physically, these would be debts that arose from a crime… Does the discharge of residual debt still apply to me if I have no money to pay the debts or is that not possible in this case?

Hi.

Debt from offences is unauthorized actions and such are not repayable. If the intentionally committed unauthorized action is dismissed, there are not even the normal attachment limits from § 850c ZPO. In the event of an unauthorized action, you may even be pledged if you are under the imposition limit and have a P account. All you have to do is stay what you absolutely need to live and then you can’t do anything anymore.

But, it does: it doesn’t matter if there is a residual debt relief, even if there is nothing to get without it.
