Cancel the purchase?

Hello, the question is above and here is the explanation of my situation.

I am 17 years old and will be 18 next summer. I am currently working on my A1 driving license until the end of the season, which some people might think is pointless, but that is not what this is about.

Almost exactly two months ago, I ordered a motorcycle from a dealer near me (€4,000) which had yet to be delivered, so I reserved it with a mandatory purchase.

Now, however, I'm beginning to doubt whether it's even worth buying a new motorcycle. While I'll get more money from selling it than if I buy a used one now (due to the existing warranty), I'll also have to pay significantly more.

The dealer has just given me a third delivery date (August 26-30), after missing two delivery dates already. I've done my research, and this, combined with the fact that everything was arranged via email and without a written contract, makes it quite easy to cancel the purchase.

Now my question is whether I should do that.

My plan was to buy a naked bike (€4,000) to be mobile until I could buy a car. My new idea is to buy a supermoto (€2,500-€3,000), which I'll probably still be riding around and cornering after my 18th birthday.

I'm not looking for opinions on naked bikes or supermotos, nor on cornering on a 125cc. I'm interested in your opinion from a financial perspective and what I get out of it.

The purchase is void, because you are limited to business.

The purchase has not been made. That’s what the dealer should have known you’re not businessable.

Under 18

If a purchase is completed without prior consent, it is floating ineffective. Parents can approve the contract afterwards, but they do not have to. If no subsequent consent is granted, the purchase contract under 18 is invalid, payments already made can be recovered.

Your parents should not agree to the purchase, then the purchase is void, as you are not yet fully operational and without the consent of your parents you cannot buy a motorcycle.

Bad luck for the dealer, he should have known if you were 18 or if your parents had consent.

Also for your planned purchase, you need the consent of your parents.

Then you were wrongly informed. Oral contracts are also valid. And if by email, it’s even more difficult to get out, because it’s written.

For you it’s really easy to step back, but also because you’re not 18 yet. Your parents only have to object to the purchase.
