Can a bus driver take my seat away from me?

Is the bus driver allowed to force me to stand up so someone else can sit there? That wasn't the case here, and if an elderly lady were to get on the bus, I would make room for her, too, but I just wanted to know if the bus driver has the right to make that decision.

Where do you live?

This depends on how it is regulated in the transport conditions of the respective provider.

In Munich, for example, this looks like:

Section 5

(1) The operating personnel may refer passengers to certain wagons if this is necessary for operational reasons or for the fulfillment of the transport obligation.

(2) The operating personnel shall be entitled to assign seats to passengers; Claim there is no seat. Seats are for disabled people, in the ability to walk impaired, elderly or fragile, mothers and for passengers with small children.

So here in Munich he can. It is a shame that such a regulation is necessary at all.

This is insignificant – All Conditions of transport are governed by the federal "Regulation on the General Conditions of Carriage and Obus Transport and Line Transport with Motor Vehicles" (BefBedV) – the paragraph of Munich's Conditions of Carriage quoted by you is even literally identical to the BefBedV

The whole would result from the conditions of transport. However, I do not know that there is a seat entitlement for any transport company which also requires standing places and also instructs them.

In my case, the conditions of the HVV apply. The following is regulated:

§ 5 Handling of carriages and seats (1) The operating personnel can passengers on certain cars or ships shall notify if necessary for operational reasons or for the fulfillment of the transport obligation. (2) The operating personnel shall be entitled to assign seats to passengers; There is no entitlement to a seat. Seats are for severely disabled persons, persons affected by walking, elderly or fragile, mothers and for passengers with small children.

If you do not follow this, you can also

§ 3 Persons excluded from the transport (1) Persons who represent a danger to the safety of the holding or to the passengers are excluded from the transport. In so far as these conditions exist, in particular 1. persons who are under the influence of mental drinks or other intoxicating means are excluded, 2. persons with contagious diseases, 3. persons with weapons covered by the Weapons Act, unless they are entitled to conduct weapons. (2) Non-school children before completion of the 6th Years of life may be excluded from the transport provided that they are not accompanied on the whole journey by persons who are at least 6 years old. The provisions of paragraph (1) shall remain unaffected.

Since you are not entitled to a seat, which is in the terms of almost all companies, he could also put you away. It would be enough for him to know that one or two stations continue to rise a legitimate person who needs a seat.

Usually, he won't do it without reason. So you can and must stand up if he likes this. There is no need for a reason directly present.

I was thrown out of the bus because, despite the severely handicapped person's 100% card, I had a seat in this regard. This had a backlash for the driver, which he never did, otherwise he is terminated.

The bus driver has the certain house right in the vehicle. This is clearly regulated in the COM. If there are enough seats available, it must not refer you to the place from a pure annoyance. This applies to Lienienverkehr (station to stop) A seat must be provided for each passenger in a long-distance travel. Greetings, Helmut

No, he can't just get you out of the bus for no reason! You must have done something bad for that. Because you finally bought a ticket and he must drive you to the bus stop until you bought the card!!

If something is to be regretted, it is sometimes necessary. It should be a matter of course that you make your place free for certain groups of people.

Unfortunately, there are people who even seem to think that even their pocket has a seat more necessary than an elderly person.

As far as I know, he can't, because, like everyone else, you've paid for exactly one seat, so you're supposed to be sitting. If you sit on a seat that is specially designed for disabled people, it might be something else but otherwise he would not have to decide otherwise.

No, he can't, you've paid, so you have the full right to the seat and there's no old grandma to sit. But it's the moral obligations and I also think it's good from the bus driver that he does. If you're acting aggressively, he can throw you out of the bus.
